This policy (“privacy policy”) describes how Aiquire Inc., doing business as Pixis, together with its affiliates (collectively “Pixis”, “we”, “our”, “us”) collect, use, share or otherwise process your personal information in relation to its website, applications, products, services, events, and experiences that reference this privacy policy. This Privacy Policy applies to all Pixis platforms, including any artificial intelligence-enabled systems, automated agents, and machine learning functionalities made available through the Services (collectively, the “Services”). Certain features of the Services may process user inputs using artificial intelligence systems and automated technologies, including third-party AI model providers, in order to generate content drafts, insights, recommendations, analytics, or other outputs. Such processing may be carried out through automated systems, including AI Agents, with limited or no human intervention. You should familiarize yourself with this Pixis privacy policy because it establishes your rights and responsibilities as a User of our website, applications, products, and services.

Where required by applicable law, Pixis relies on one or more of the following legal bases for processing personal information: a) your consent; b) performance of a contract or steps taken at your request before entering into a contract; c) Pixis’s legitimate interests, including improving services, securing systems, preventing fraud and operating our business; d) compliance with legal obligations; and e) protection of rights, safety and security.

Pixis processes personal information in different capacities depending on how you interact with us. These include:

  • Website Visitors: where you browse our websites, submit forms, or interact with public pages;
  • Prospective Customers / Demo Requests: where you request a demo, product information, meetings, proposals, events, newsletters or other pre-contractual interactions;
  • Platform Users: where authorized users access Prism, Adroom, Pixis Visibility or other Pixis products;
  • Customer Data Processed Through the Services: where Pixis processes information on behalf of customers under applicable contracts and data processing agreements; and
  • AI Feature Users: where users submit prompts, files, inputs or commands into AI-enabled product features

Pixis Services are designed for businesses and are not intended for personal/ individual use. We, hence treat most individuals who contact us about our services, including all visitors (except visitors who are end users) and Platform Users, as individuals acting as business representatives rather than in their personal capacity. Where Pixis processes personal information on behalf of its business customers, Pixis acts as a “data processor” or “service provider,” and such customers act as “data controllers” responsible for determining the purposes and means of processing. Customers are solely responsible for ensuring that they have a valid legal basis for the collection and processing of personal information submitted to the Services. The parties acknowledge that the Services are not primarily designed to require the processing of Personal Data; however, Personal Data may be processed incidentally depending on Customer-provided datasets, integrations, and configurations.

Depending on the context and applicable law, Pixis may process contact information and demo requests on the basis of consent, pre-contractual necessity, legitimate interests in responding to business inquiries, compliance obligations, or other lawful bases permitted under applicable law.

Pixis operates globally. Personal information may be processed in countries other than the country in which you reside. Where required by law, Pixis implements appropriate safeguards for international transfers.

This privacy policy has been designed with these key principles in mind:

  1. To set out the required disclosures about the way we use information that you share with us as visitors, platform users, and end users.
  2. To ensure that you understand what information we collect with your permission, what we do, and, most importantly, what we do not do with that information.
  3. To assume responsibility for protecting your rights and your privacy under this policy.

Highlights of what the privacy policy covers:

  1. The use of cookies and other tracking technologies.
  2. The transfer of your information outside of the country where you live.
  3. The collection, use, processing, and retention of your information by the entities described in this privacy policy, including Pixis, as Data Controller (where applicable), as indicated at the bottom of this document.

For purposes of this policy:

‘Personal Information’ for non-residents of the European Economic Area (other than California residents) means any information that can be used to identify, contact, or precisely locate a person, including name, email, address, and telephone number.

‘Personal Information’ for residents of the European Economic Area means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. This includes IP address and advertising ID (IDFA/AAID).

‘Personal Information’ for residents of California means information that identifies a particular California consumer or household, including, without limitation, name, unique personal identifier, online identifier, geolocation data, professional or employment-related information, or other information as defined in the CCPA. This includes IP address and advertising ID (IDFA/AAID).

‘Non-Personal Information’ means information not included in the definition of Personal Information, such as pages or ads visited, time spent on pages, browser and device type, and referring and exit pages.

‘Data Controller’ refers to entities including advertisers and publishers with whom you may have shared any data which alone or jointly with others determines the purposes and means of the processing of personal information.

‘Personal Data Breach’ means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal information transmitted, stored, or otherwise processed in connection with the provision of the Pixis Services.

1. Information we collect/receive

In general, there are three categories of information we collect:

  1. information that we can use to provide additional features and improved experiences if you choose to share that information;
  2. information that we must have for you to use the Pixis Services; and
  3. information collected from your interaction with the Pixis services.

Information collected from your interaction with the Pixis Services may include technical usage data, interaction events, session identifiers, device metadata, and behavioral analytics data generated when users interact with the platform interface. Such information may be collected through analytics tools, cookies, or similar monitoring technologies used to support platform analytics, performance monitoring, and product improvement. Depending on the product used, Pixis may process campaign data, advertising performance metrics, reporting data, prompts, creative assets, user settings, workflow inputs, CRM data, account identifiers and platform telemetry.

Personal Information collected is either by consent or performance of a contract/agreement with you and/or for any pre-contractual obligations thereof.

This Personal Information includes, but is not limited to, name, email id, address, contact number, organization name, job title, account credentials, and business contact details. For certain Pixis platforms, Pixis may also collect user inputs submitted through the platform, including text prompts, uploaded documents, draft content, voice inputs, or other content provided by users for processing through the Services (“User Inputs”). Where voice input functionality is enabled, Pixis may process audio inputs using speech-to-text technologies in order to convert spoken input into text for use within the Services.

Where users connect third-party accounts to the Services (for example, social media platforms such as LinkedIn), Pixis may receive account identifiers, authentication tokens, profile metadata, and other information necessary to enable the requested integrations and publishing functionality.

Customer shall not submit sensitive personal data (including health data, biometric data, financial account credentials, or government-issued identifiers) to the Services unless expressly permitted by Pixis in writing and subject to additional safeguards.

2. How we use that information

Information we collect may be transferred, stored, used, and/or processed as follows:

Contact information: When you contact us through the “Contact Us”, “Book a Demo”, “Get Access”, “Subscribe” buttons, event registrations, partner channels, webinars, or similar touchpoints, we may collect your name, email address, company name, business title, country, phone number and related professional contact details. We may use this information to: (a) respond to your request; (b) schedule meetings or demos; (c) provide requested materials or proposals; (d) administer business communications; (e) provide service-related notices; and (f) send marketing communications where you have provided any required consent or where otherwise permitted under applicable law.

Phone, WhatsApp and SMS Communications: Where you provide a phone number, Pixis may use such number to contact you regarding your enquiry, requested demo, customer support matters, account administration, onboarding, or other communications reasonably connected to your interaction with Pixis. Where required by applicable law, Pixis will obtain your consent before sending promotional or marketing communications via telephone, SMS, WhatsApp, instant messaging applications or similar channels. You may opt out of marketing communications at any time by using the unsubscribe mechanism provided, replying STOP where available, or contacting Pixis using the details below.

AI-enabled features: Certain Pixis Services include artificial intelligence, machine learning, automation or agent-based functionality that may process user inputs, prompts, uploaded content, campaign data, business records, instructions or metadata in order to generate drafts, analytics, recommendations, workflows, summaries or outputs. Such processing may involve third-party service providers engaged under contractual safeguards. Pixis does not use Customer Content or Customer Personal Data to train generalized public artificial intelligence models unless expressly agreed in writing with the relevant customer. Customers remain responsible for reviewing outputs for suitability, accuracy and lawful use.

Use of Cookies and Similar Technologies: Pixis may use cookies, local storage, and similar technologies to support the operation and functionality of the Services. These technologies may be used for purposes including authentication, session management, security monitoring, analytics, and improving user experience. Analytics tools and product monitoring technologies used by Pixis or its service providers may also use cookies or similar technologies to collect information about user interaction with the platform, including navigation behavior, session activity, feature usage patterns, and interaction events. Where required under applicable law, Pixis may provide cookie banners, consent management tools or similar preference mechanisms allowing users to accept, reject or manage non-essential cookies and tracking technologies. Users may update cookie preferences through available settings tools, browser controls or device-level configurations, subject to technical limitations.

Billing information: In certain circumstances, to use the Pixis services, you may be required to provide additional information, which may include a name, credit card number, and expiration date. Pixis uses this information to process payments. In certain circumstances Pixis uses third-party service providers to manage credit card processing.

User activity data: In an ongoing effort to improve the website and the Pixis services, we automatically collect certain information when visitors visit the website and when platform users use the Pixis services (“User Activity Data”). This information may include IP address, browser and device type and language, referring and exit pages and URLs, date and time, amount of time spent on pages, what sections of the website visitors visit, and other aggregate user data concerning your use of the website and the Pixis services. In connection with certain Pixis platforms, Pixis may also collect technical metadata associated with platform usage, including authentication logs, device identifiers, session identifiers, API request logs, and notification tokens used to support platform functionality, security monitoring, and service performance. Pixis may also use product analytics and usage monitoring tools, including third-party analytics platforms, to understand how users interact with the Services and to improve platform functionality, performance, and reliability. These tools may collect technical usage information such as feature interactions, navigation paths, device information, and session metadata. In certain cases, Pixis may use session replay or session recording technologies to analyze how users interact with the platform interface. These technologies may capture interaction events such as clicks, scrolling activity, mouse movements, and navigation patterns within the Services for purposes including product improvement, debugging technical issues, usability analysis, and performance optimization. Pixis applies reasonable technical and organizational safeguards designed to minimize inadvertent collection of sensitive information through such technologies.

Product Analytics and Session Technologies: Pixis may use analytics, diagnostics, telemetry, logging and product improvement tools to understand usage patterns, improve functionality, maintain security and troubleshoot issues. Where required by law, Pixis will obtain consent before deploying non-essential cookies or similar technologies.

3. Data retention

Pixis retains personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including legal, contractual, tax, dispute resolution, compliance, security and legitimate business purposes.

Indicative retention periods may include:

  • Demo requests / prospect records: up to 24 months after last meaningful interaction, unless converted to customer records;
  • Customer account data: for the duration of the relationship and applicable post-termination legal retention periods;
  • Marketing consent records: until consent is withdrawn and for a reasonable evidentiary period thereafter;
  • Suppression / opt-out records: as necessary to honour future communication preferences;
  • Security logs / audit records: as reasonably necessary for fraud prevention, investigations and security operations.

Pixis may anonymize or aggregate information so that it no longer identifies an individual.

4. Sharing and Disclosure of your Personal Information

We may share your information at your direction or as described below at the time of sharing.

Customers: We share user activity and ad interaction data with our customers, who may use this information for their lawful advertising purposes to provide you with a more personalized online advertising experience. We follow customer instructions concerning sharing and disclosing this data, including any applicable terms in our customer agreement or customers’ use of the Pixis services.

Third-party service providers: Pixis may share your information with third-party service providers that support us in delivering the Pixis services to our customers. Such service providers may include cloud hosting providers, artificial intelligence model providers, speech-to-text providers, analytics providers, authentication providers, messaging infrastructure providers, and payment processors. These providers may process personal information solely on Pixis’s behalf and in accordance with contractual obligations requiring them to protect the confidentiality and security of such information.

To comply with the law: Pixis may disclose your information to courts, law enforcement or governmental authorities, or authorized third parties if and to the extent we are required to do so by law, regulation, or legal process.

Business transfers: If Pixis undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, we may sell, transfer, or share some or all our assets, including your personal information. To the extent required by applicable law, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

To enforce our rights, prevent fraud, and for safety: Pixis may use personal information to protect and defend the rights, property, or safety of Pixis or its customers, including enforcing contracts or policies or in connection with investigating and preventing fraud or security issues.

Corporate affiliates: Pixis may share data with its corporate affiliates, its parents, and/or subsidiaries. Others Pixis may also disclose your information under circumstances not mentioned here with the prior consent of the person or third-party that submitted the information to us.

5. Your Choices

Cookies Usually, you can stop your browser from accepting cookies in general or from accepting cookies from a particular website. All modern browsers allow you to change your cookie settings. You can typically find these settings in the ‘options’ or ‘preferences’ section of your browser.

Marketing communications You may choose to sign-up for marketing or other communications from Pixis on the website. Should you choose to unsubscribe from any lists for which you registered, you may do so by following the instructions on how to unsubscribe provided in all Pixis communications or by emailing dpo@pixis.ai.

6. How do we protect your information

Pixis applies reasonable technical and organizational safeguards designed to protect personal information. However, no method of transmission over the internet or method of electronic storage is completely secure, and Pixis cannot guarantee absolute security. Users remain responsible for protecting account credentials and using secure systems when accessing the Services.

In the event of a confirmed personal data breach affecting personal information, Pixis will take steps required under applicable law, which may include notifying affected individuals, customers and competent supervisory authorities within legally required timeframes.

7. Where do we store the information

Our servers, cloud infrastructure, systems, support operations, and service providers may be located in India, the United States, the European Union, the United Kingdom, Singapore, Australia and other jurisdictions where Pixis or its authorized service providers maintain operations. Accordingly, personal information may be transferred to, accessed from, stored, or processed in jurisdictions outside the country in which you reside.

Where such cross-border transfers occur, Pixis implements safeguards designed to protect personal information in accordance with applicable data protection and privacy laws. Depending on the applicable jurisdiction and transfer context, such safeguards may include: (a) the European Commission’s Standard Contractual Clauses (“EU SCCs”); (b) the UK International Data Transfer Agreement (“IDTA”) or the UK Addendum to the EU SCCs; (c) adequacy decisions issued by competent regulatory authorities; (d) the EU-U.S. Data Privacy Framework (“DPF”) where applicable; (e) contractual confidentiality and data protection obligations imposed on service providers; and/or (f) other lawful transfer mechanisms recognized under applicable law.

Pixis periodically reviews applicable transfer mechanisms and may update such mechanisms where required to reflect changes in legal, regulatory or operational requirements.

8. Third-party social media features

Our website may use social media features, such as ‘Like’ and ‘Share’ buttons, operated by third parties such as Facebook, Instagram, LinkedIn, Twitter, etc. Certain Pixis services, may also enable users to connect their social media accounts in order to create, schedule, or publish content directly through such platforms. Where users enable such integrations, Pixis may receive limited account information necessary to enable authentication, posting, or analytics functionality. Your interactions with these third-party platforms are governed by the privacy policies and terms of those platforms.

9. Trusted Third-Party Solutions Providers

Pixis uses trusted third-party solution providers who design and manage their services in alignment with industry security standards such as SOC2 and ISO 27001. Pixis may utilize cloud infrastructure providers, artificial intelligence model providers, analytics providers, messaging infrastructure providers, and other technical service providers to support the operation of its services. These providers may include product analytics and monitoring platforms that help Pixis understand how users interact with the Services and improve platform functionality and reliability.

10. Sale of Personal Information

Pixis does not sell the Personal Information collected for commercial purposes.

11. Children’s Privacy

The Website and Pixis Services are not directed to children under the age of 16, and Pixis does not knowingly collect personal information from children under the age of 16. If Pixis becomes aware that personal information has been collected from a child under 16 without appropriate consent, Pixis will take reasonable steps to delete such information.

12. Links to other sites

Our website and the ads we serve on behalf of customers may, from time to time, contain links to external websites. Pixis encourages you to review the privacy and security policies of any externally linked websites whose information practices may be different from ours. Pixis assumes no responsibility or liability for the information, collection, and disclosure practices of any external websites that a visitor can access through the website or the Pixis services. Please check the privacy policies of these external websites before you submit any personal information or other information to them.

13. Marketing Preferences and Choices

You may choose whether to receive promotional communications from Pixis. Where required by law, Pixis will request your consent before sending such communications. You may withdraw consent or update preferences at any time. Withdrawal does not affect prior lawful processing.

14. Your Rights

You have the right under this privacy policy and by the applicable laws to:

14A. India-Specific Privacy Rights (Digital Personal Data Protection Act, 2023)

For individuals located in India, Pixis processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (“DPDPA”) and applicable implementing rules, where applicable. Where consent is relied upon as the legal basis for processing, Pixis seeks to ensure that such consent is free, specific, informed, unconditional and provided through a clear affirmative action.

Indian users may withdraw consent at any time by using available opt-out mechanisms or by contacting Pixis using the details provided in this Privacy Policy. Withdrawal of consent shall be as easy as the giving of consent, subject to applicable legal or contractual restrictions.

Pixis may process personal data for lawful purposes connected with the provision of the Services, customer support, account administration, onboarding, analytics, fraud prevention, security monitoring, legal compliance, business communications and, where permitted by law, marketing and promotional communications.

Where promotional SMS, WhatsApp or similar communications are directed to Indian phone numbers, Pixis may implement applicable Telecom Regulatory Authority of India (“TRAI”) compliance measures, including consent management processes and Do Not Disturb (“DND”) screening procedures, where required under applicable law.

Indian users may submit grievances, complaints or requests relating to personal data processing to the Grievance Officer identified below. Users may also have the right to lodge complaints with the Data Protection Board of India (“DPBI”) in accordance with applicable law.

14B. United Kingdom Privacy Rights

For individuals located in the United Kingdom, Pixis processes personal information in accordance with the UK General Data Protection Regulation (“UK GDPR”), the Data Protection Act 2018 and, where applicable, the Privacy and Electronic Communications Regulations (“PECR”). Where required under applicable law, Pixis seeks to obtain consent before sending direct marketing communications through electronic channels or deploying non-essential cookies and similar technologies. Individuals located in the United Kingdom may lodge complaints with the UK Information Commissioner’s Office (“ICO”).

14C. European Economic Area Privacy Rights

For individuals located in the European Economic Area (“EEA”), Pixis processes personal information in accordance with the General Data Protection Regulation (“GDPR”). Depending on the processing activity, Pixis may rely on one or more lawful bases including: (a) consent; (b) performance of a contract or pre-contractual measures; (c) compliance with legal obligations; (d) legitimate interests; and/or (e) protection of rights, security and fraud prevention interests. Where Pixis relies on legitimate interests as a lawful basis, Pixis seeks to balance such interests against applicable rights and freedoms and may implement additional safeguards where appropriate. Individuals located in the EEA may lodge complaints with their competent supervisory authority.

14D. Latin America Privacy Rights

Pixis may process personal information relating to individuals located in Latin American jurisdictions, including Brazil, Mexico, Colombia and Argentina, in accordance with applicable privacy and data protection laws. Where applicable, Pixis seeks to comply with Brazil’s Lei Geral de Proteção de Dados (“LGPD”), Mexico’s Ley Federal de Protección de Datos Personales en Posesión de los Particulares (“LFPDPPP”), and similar regional frameworks governing the collection, use, transfer and protection of personal information. Users located in such jurisdictions may contact Pixis to exercise applicable privacy rights or request additional information regarding international transfers and processing activities.

14E. Australia Privacy Rights

For individuals located in Australia, Pixis seeks to handle personal information in accordance with the Australian Privacy Act 1988 and applicable Australian Privacy Principles (“APPs”). Where required by law, Pixis seeks consent before sending commercial electronic communications and provides functional unsubscribe mechanisms in accordance with the Spam Act 2003. Pixis may implement reasonable compliance measures designed to support compliance with the Do Not Call Register Act 2006 (“DNCR Act”), including screening procedures for outbound communications involving Australian telephone numbers, where applicable. Australian users may contact the Office of the Australian Information Commissioner (“OAIC”) regarding privacy complaints or concerns.

15. Exercising your rights

You may exercise your rights of access, rectification, object, transfer, restriction, and erasure by contacting us at dpo@pixis.ai. Please note that we may ask you to verify your identity before responding to such requests. Where required under applicable law, Pixis may maintain records relating to rights requests, consent withdrawals, suppression preferences, opt-out requests, grievance submissions and related compliance actions. If you make a request, we will respond to you as soon as possible. You have the right to complain to the Data Protection Authority about our collection and use of your personal information. Where consent is required under applicable law for specific processing activities (including certain cookies, marketing communications, or optional features), Pixis will seek such consent separately. Where you provide consent, you may withdraw it at any time, subject to applicable law.

18. Changes to the privacy policy

Pixis may update this Privacy Policy from time to time to reflect changes in applicable law, regulatory guidance, business operations, products, technologies, security practices, processing activities or compliance requirements. Where required, Pixis will provide notice of material changes through the Services, website notices, email communications or other appropriate mechanisms. Continued use of the Services following the effective date of an updated Privacy Policy constitutes acknowledgment of the revised Privacy Policy to the extent permitted by applicable law. Users are encouraged to periodically review this Privacy Policy to remain informed regarding Pixis’s privacy and data handling practices.

Disclosure:

Pixis and Pixis Analytics’ use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.
